Port Blair, Sept 09: The Hon’ble Special Judge Mr. Raja Chatterjee on 07th September 2022 convicted one accused person namely Andrew, resident of Sawai Village, Car Nicobar in a sexual assault case committed by him against a minor girl then aged about five years. It is averred that on 01.11.2015 the victim girl was found to be with the accused at a closed door where the victim was crying and the same was heard by her grandmother and on her approach, she found the accused in a compromising situation.
Then the matter was brought to the notice of PS Car Nicobar and they registered a case against the accused person under Section 376 of the Indian Penal Code (IPC) read with Section 03 and 04 of the POCSO Act, however, the charge was framed under Section 05 and 06 of POCSO Act and Section 376 of IPC.
The prosecution examined 13 witnesses and the Hon’ble Court afterconducting a trial found the accused person guilty of the offence andsentenced him to suffer 10 years of rigorous imprisonment under Section 06 of the POCSO Act and ordered him to pay a fine of Rs. 10,000/- in default of payment of such fine further rigorous imprisonment of 06 Months.
The Special Court also awarded a sum of Rs. 2,00,000/- (Rupees Two Lakhs only) as compensation for the rehabilitation of the victim girl. The case was conducted for and on behalf of the State by Special Public Prosecutor, Ms. A.S Zinu.
