Port Blair, Sept 30: Following a media report, the Hon’ble High Court of Calcutta, Circuit bench at Port Blair on 27 September 2018 took a suo moto action on the serious issue of keeping the post of Chairperson, UT Commission for Protection of Child Rights in these Islands, vacant and has issued notice directing the Administration to file the reply on this issue failing which a order writ for mandamus will be issue.
The move of The Hon’ble High Court of Calcutta, Circuit bench at Port Blair has brought new hope for the Andaman and Nicobar Islands society as children are most vulnerable section of any society.
The Hon’ble High court in its direction noted that in absence of a Chairperson, the commission is unable to discharge its normal duties as complaints of child rights violation are put on hold.
“The court cannot shut its eye to social realities and as such this court has decided to issue a suo moto rule in this regard in the opinion of this Court, the inaction on the part of the Administration in keeping the said post vacant for such a long time tantamount to not only violation of basic human rights but is violative of several Articles of the constitution of India assuring protection to citizen in general and children in particular,” the Hon’ble High Court noted.
