Port Blair, Dec 05: Most of us see people throwing garbage in open and undesignated places thus making our surroundings not only filthy, unclean but also extremely unhygienic. Moreover, some people are also in the bad habit of spitting, urinating and defecating in open places. This is not only making our environment polluted but also poses a serious health hazard to the general public at large. The A & N Police and IRBn have started a drive to educate the people and more than 7000 people have been educated in this regard.
Kind attention is now drawn of the general public towards Section 34(5) of the Indian Police Act, 1861, which provides for fine or imprisonment with or without hard labour upto eight days by a Magistrate and he/she can be taken into custody without any warrant by any police officer for acts of any person, who throws or lays down any dirt, filth, rubbish or any stones or building materials, or who constructs any cowshed , stable or the like, or who causes any offensive matter to run from any house, factory, during heap or the like. Further, the acts of any person who willfully and indecently exposes his person, or any offensive deformity or disease, or commits nuisance by easing himself, or by bathing or washing in any tank or reservoir not being a place set apart from that purpose as stipulated under Section 34(7) of Indian Police Act, 1861 also envisages the said fine or imprisonment.
The A & N Police has now decided to enforce this law in strict earnest and people found indulging in such activities will be booked under the relevant Sections of the said Act.
A plea is once again being made as a part of the Swachcha Bharat Campaign to the general public to not to indulge in such acts and be a part of the efforts of the A & N Police and the Administration in our endeavour of keeping these islands clean and beautiful, the Director General of Police said in a press release.
If Only a police officer finds any person doing the above mentioned act then the same police officer will book the person. Then this will only be concerned to that police office if he/she want to book or want not to book the person doing those act.
But if I or (any citizen of INDIA) see any person doing those above mention acts, what kind of proof (Photographs/videos/ any other please mention) will be required by the Director General of Police from me (any citizen of INDIA) witnessing the act,so that the person doing the act can be fined or imprisoned.
