Port Blair, Jul 11: Mr. B.P. Ray, Member of Parliament, Andaman and Nicobar Islands in his letter addressed to the Lt. Governor has informed him that in pursuance of the GOI, Ministry Of Power letter No. 34/2/2005-R&R, dated, 02.07.2009 the GOI, Ministry of Power, Andaman & Nicobar Administration had created 495 posts of Mazdoors in the Electricity Department of Andaman and Nicobar Administration Consequent to that the Electricity Department. Of Andaman and Nicobar Administration had regularized the 495 posts of Mazdoors with prospective effect with consequential benefits.
He added that the 495 Mazdoors of Electricity Department were working in Electricity Department of Andaman and Nicobar Administration since 1994 onwards as Daily Rated mazdoor’s with same nature of works at par with their counterparts regular Mazdoors in same Department. Out of 495 most of them are in verge stage of their life and due to regularizing of their service in prospective nature, they were deprived from the pensionary benefits.
He also informed the L t. Governor that upon finding no others alternative the stake holders approached a writ petition before the Hon’ble High Court, Circuit Bench at Port Blair vide Petition No. WPCT No. 666/2012 (Shri. J.Lokanathan & Ors—Vs—Union of India & ors. ) and his Lordship had passed an order which said” EXTENT THAT THE PETITIONERS SHALL BE DEEMED TO BE IN SERVICE FROM THE DATE OF ACTUAL ENGAGEMENT ONLY FOR THE PURPOSE OF RETIRAL AND PENSIONARY BENEFITS AND NOT FOR ANY OTHER PURPOSE”.
Quoting the judgment Mr. Ray requested the Lt. Governor to implement the court orders at the earliest for the benefit of the mazdoors.
