Mayabunder, Apr 22: This is the painful story of an innocent angel victim-child, who was aged about just eleven years at the time of incident and who has been raped, ravished and sexually exploited by her maternal uncle. Consequence of such incident, the victim became traumatic. The factual matrix as reflected in a nutshell is that some times in the month of January,2019 the accused picked up victim and took her inside his house and laid her on cot and committed rape on her. Accused also kissed her on cheek and also threatened her. For that reason and on the basis of written fardbayan of the victim, FIR No. 09 of 2019, dated 20/01/2019 under section 5/6 of POCSO Act, 2012 read with section 376 AB of IPC has been lodged at Police Station Diglipur. The prosecution has sufficiently proved that the accused has committed the offence under section 6 of POCSO Act,2012 for committing aggravated penetrative sexual assault to a minor girl of just eleven years. Accordingly, on 22nd April,2021, Shri. Jimut Bahan Biswas, Hon’ble Additional Sessions Judge -cum- Special Judge under POCSO Act, North & Middle Andaman, Mayabunder has found guilty the accused namely Gourab Biswas S/o Shri. Gobinda Biswas (20 years) R/o Sitanagar, Diglipur and sentenced him to undergo imprisonment for life for the offence under section 6 of POCSO Act, 2012 and under section 376 AB of IPC under the provision of 235 (2) of Cr.P.C and also to pay fine of Rs.2,00,000/- (rupees two lakhs only), out of which 90 percent amount is to be paid to the victim as compensation under section 357 Cr.P.C, in default of payment which he will have to undergo rigorous imprisonment for one year more.
For the rehabilitation of victim girl, an amount of Rs.5,00,000/- (rupees five lakhs only) has been awarded as compensation as per provision u/sec. 357A Cr.P.C read with section 33 (8) of POCSO Act and rule 7 of POCSO rule, which will be paid by the Government from Government Fund through NEFT. This case was investigated by SI Roshan George as well as SI Jishi George and charge-sheeted by Inspector Sahil Samsuddin, former SHO, Police Station Diglipur. The entire prosecution case was conducted by Shri. Uttam Kirtania, Learned Additional Public Prosecutor -cum- Special Public Prosecutor (POCSO Act), Mayabunder.
