Port Blair, Jun 28: On a clear input received from reliable sources on 05/02/2017, a team of officials comprising Police personal of CCS branch of A&N Police and Food Safety Officials apprehended Mr. Fiyaz Khan S/o late A.A.Khan R/o Junglighat with 3600 tins of different varieties of contraband tobacco products (Zarda) at VSI Airport.
Mr. Fiyaz Khan has transported these contraband products from Bangalore to Port Blair through personal cargo, a release from Joint Commissioner Food Safety said here today.
The release added that on 6th February’2017, a case was instituted against Mr. Fiyaz Khan, u/s 26(2)(iv) of Food Safety & Standards Act’2006 at the Court of Additional District Magistrate(ADM), South Andaman(Adjudicating Officer). The Adjudicating Officer/ADM on 7th February’2017 on hearing of the case has imposed a fine of Rs.1,50,000/-(Rupees One lakh Fifty thousand only) with the direction to remit the fine amount to the Govt. treasury with in a period of 07 days.
The release further added that Mr. Fiyaz Khan has failed to deposit the fine within the stipulated period given to him.
Further Mr. Fiyaz Khan was served a show cause notice on 02/06/2017 giving once again an opportunity to remit the fine amount of Rs. 1,50,000/-(Rupees One lakh Fifty thousand only) failing which the property(s) standing in different locations at South Andaman be not put to auction for recover of the money imposed as penalty for violation of section 26(2)(iv) of Food Safety and Standards Act’2006.
Mr. Fiyaz Khan has once again failed to comply with the show cause notice issued in his favour. Since under section 96 of Food Safety & Standards Act’2006, “a penalty imposed under this Act, if it is not paid, shall be recovered as an arrear of land revenue”.
Therefore in accordance with the Law, the District Magistrate, South Andaman directed the Executive Magistrate to seal the premises. Accordingly the Executive Magistrate on 27/06/2017 sealed the premises standing at Sy. No. 33/3/1 situated at Aberdeen Village which stands recorded in the name of Mr. Fiyaz Khan.
