Mayabunder, Oct 05: A money execution case was filed by the decree holder before the Hon’ble Court of Additional District Judge, North & Middle Andaman, Mayabunder for realization of the decreetal amount of Rs. 20,27,221/- together with interest in respect of arbitration case. It is also learnt from reliable sources that Hon’ble Court has been pleased to pass an order in the previous occasion for attachment of the movable and immovable properties of the judgment debtor namely Zilla Parisad, North & Middle Andaman, Mayabunder but the same was recalled on the basis of undertaking by the said judgment debtor to pay the decreetal amount but they failed to pay the same although several opportunities were given to them.
It is also learnt that Hon’ble Court has expressed the displeasure for delaying the proceeding by preferring various vexatious applications and disobeying the order of Hon’ble Court by the present Chief Executive Officer, Zilla Parisad, Mayabunder as a result decree holder can not get the fruits of the decree.
It is also found by the Hon’ble Court that due to delay of making payment the interest of decreetal amount are increased day after day and for such disobedience of the Hon’ble Court’s Oder, the Government Exchequer is destroying. Finally, on 04th October, 2021, the Hon’ble Additional District Judge, North & Middle Andaman District has been pleased to pass an order for attachment and auction of the movable and immovable properties of the judgment debtor namely Zilla Parisad, Mayabunder till realization of decreetal amount together with interest.
The Attaching Officer of the Court was directed to cause actual seizure of the properties of judgment debtor and to submit the execution report.
