Port Blair, Feb 06: Justice B. Rajendran, Chairperson, Tamil Nadu Real Estate Appellate Tribunal (TNREAT), Andaman & Nicobar Islands and Pondicherry along with Mr. M. Malaichamee, Secretary (Finance & Administration) and Mr. S. Selvakumar, Secretary (Projects), Tamil Nadu Real Estate Regulatory Authority (TNRERA) are visiting Andaman & Nicobar Islands for conduct of an awareness programme on the provisions of Real Estate (Regulation & Development) Act, 2016.
Earlier an awareness programme for the Real Estate Promoters/Developers and Real Estate Agents on the provisions of Real Estate (Regulation & Development) Act was organized on 06/11/2017 at Port Blair. The 2nd awareness programme is proposed to be organized jointly by the APWD, A&N Administration and the Port Blair Municipal Council on 08/02/2019 at 9.00 am to 12.00 Noon at Dr. B.R. Ambedkar Auditorium, Aberdeen Bazar, Port Blair.
Regarding Real Estate (Regulation & Development) Act, 2016, the Government of India has notified the Andaman and Nicobar Islands Real Estate (Regulation and Development) (General) Rules, 2016 vide No.754 dated 31/10/2016 to carry out the provisions of the Act. Under the Act, no Promoter shall advertise, market, book, sell or offer for sale or invite persons to purchase in any manner any plot, apartment or building, as the case may be, in any real estate project or part of it, without registering the Real Estate Project with the Tamil Nadu Real Estate Regulatory Authority (TNRERA) which has been appointed by Lt. Governor as the Andaman & Nicobar Islands Real Estate Regulatory Authority (ANRERA). It is clarified that registration of a Real Estate Project with TNRERA is mandatory where the area of the project to be developed exceeds 500m2 or where the number of dwelling units proposed to be developed exceeds 8 Nos. Further the Builders/Developers while releasing advertisement in the media for their project will have to mention the Real Estate Regulatory Authority Registration Number, as applicable, without fail. For projects completed prior to the notification of the Rules, the details of Completion Certificate/ Occupancy Certificate as applicable shall be mentioned. The Funding Institutions may also take note of these directions. Similarly, property dealers, brokers, middlemen by whatever nomenclature they be called shall also have to register with the TNRERA. It is also informed that failure of registration of the project by the promoters or carrying out activities without registration as Real Estate Agent with TNRERA is an offence and shall be punishable with imprisonment or fine or both. Online registrations of Real Estate Projects and Real Estate Agents are already underway through this web portal.
The A&N Administration has appointed the Chief Engineer & Town Planner as the Nodal Officer for interaction/coordination with Real Estate Regulatory Authority of Tamil Nadu and designated the Town & Country Planning Unit, Andaman Public Works Department as Nodal Agency for dealing with all matters related to the Act in the Andaman & Nicobar Islands and to offer clarifications if any.
All the stakeholders who are involved in Real Estate Sector Projects including general public who are interested in the Real Estate sector are invited to take part in the awareness programme.
