Port Blair, Sep 12: The Hon’ble Court of Judicial Magistrate First Class, Mayabunder presided over by Mr. Arnab Roy Chowdhury, convicted the accused on 07th September 2022 namely Ashish Bhaskar, ShibaniHowladar, Sandhya Goldar and Laxmi Roy for the offence punishable under section 147/149/342/324/504/506 of IPC in connection with FIR No. 49/11 dt. 21/05/2011 of PS Diglipur and sentenced them to suffer Simple imprisonment for six (06) months for having committed an offence punishable under section 324 of IPC, two (02) months for having committed an offence punishable under section 147 of IPC and to pay a fine of Rs. 500/- for each under section 342, 504 and 506 of IPC.
The Court after proper appreciation of evidence adduced on behalf of the prosecution came to the finding that the facts which are essential to be stated for adjudication of the instant case are that on 21/05/2011, the informant/Papiya Das was going to provide food to her parents who were working at a construction site situated at the Smith Islands. She was intercepted and verbally abused by the accused persons namely Ashish Bhaskar, ShibaniHowladar, Sandhya Goldar and Laxmi Roy.
Following a confrontation, the lady was brutally thrashed by the accused persons who are said to have immobilized her by binding her to a beetel plant, with her hands wrapped by a towel. The scream of the helpless lady attracted the attention of the people from the neighbouring area and the accused person, fearing for their safety and ran away.
The Court at the time of pronouncement of its judgment observed that the critical analysis, keen appreciation of the evidence and studied scrutiny of the oral evidence and other materials, the court has arrived at the conclusion that the Prosecution has been able to prove its case beyond reasonable doubt and establish all the charges against the accused persons. The State Prosecution was conducted by the Prosecution wing of District Administration, North & Middle Andaman, Mayabunder.
