Port Blair, Jan 31: Shri Jimut Bahan Biswas, Hon’ble Special Judge under the POCSO Act, North & Middle Andaman, Mayabunder has convicted one accused namely Nikhil Sardar (aged about 60 years) R/o Phooltala under PS Kadamtala on 27/01/2022 by sentencing to undergo rigorous imprisonment for five years for the offence punishable under section 10 of POCSO Act, 2012 and also to pay fine of Rs. 50,000/- (rupees fifty thousand), out of which 90% amount is to be paid to the victim girl as compensation under section 357 of Cr.P.C.
The Hon’ble Court further awarded a compensation amount of Rs. 50,000/- (rupees fifty thousand) to the victim as per provision of 357 (a) of Cr.P.C from Victim Compensation Fund of the State.
The case was registered under POCSO Act in Police Station Kadamtala vide FIR No. 01 of 2022 on 07/01/2022 at the evening hours on the basis of complaint lodged by the mother of 06 (six) years old victim girl against a accused person of 60 (sixty) years old.
The entire investigation of this case was done by Women Sub- Inspector, Smti. V. Satyawathi under the guidance of Sub- Inspector, Mr. Abdul Rahaman, SHO, PS Kadamtala under the close supervision of Mr. Vichitra Veer, IPS, Superintendent of Police (D), Mayabunder.
This is a custodial trial case wherein the investigation was completed by the Investigating Officer within six days from the date of FIR and trial including date of judgement as well as date of sentence of quantum of punishment was concluded within nine days from the date of framing charge against the accused. The State Prosecution was conducted by Mr. Keshab Chandra Mondal, learned Special Public Prosecutor (POCSO Act), Mayabunder.
