Mayabunder, Dec 08: The Hon’ble Court of Judicial Magistrate First Class, Mayabunder on 07.12.2021 had convicted a retired Regular Mazdoor of the Forest Department for the offences punishable under Section 468/471 of IPC. The Retired Forest Mazdoor namely, Nepal SiRetired ngh is a resident of Mithila village under Rangat Sub Division. The prosecution case was conducted by Ld. APP, Shri Pradeep Ram.
The court after proper appreciation of evidence adduced on behalf of the prosecution came to the finding that Nepal Singh had gained employment in the Forest Department under the office of Divisional Forest Officer, Middle Andaman by submitting a false affidavit wherein he had suppressed his actual date of birth.
Nepal Singh had reduced his age by ten years in the said false affidavit sworn by him before the Executive Magistrate, Rangat and on the strength of such false affidavit he obtained employment as Regular Mazdoor in the Forest Department. The investigation of the case was conducted by SI T. Hemawathi.
The prosecution had exhibited the false affidavit submitted by the convict, Nepal Singh at the time of his initial appointment in the Forest Department and many other service related documents of the convict were produced before the court during trial.
The court at the time of pronouncement of its judgment had observed that there were sufficient materials on record in the form of exhibited documents to establish the fact that the accused, Nepal Singh had manufactured a concocted document in the form of an affidavit with an intention to commit fraud upon the Government Department for gaining employment unlawfully by way of suppressing his actual date of birth. Nepal Singh was sentenced to undergo one year of simple imprisonment and a fine amounting to Rs. 10.000/in total was imposed against him by the court.
