Port Blair, Sept 13: Shri. Subhajit Basu, Hon’ble Special Judge under the POCSO Act, North & Middle Andaman District, Mayabunder has convicted one accused person namely Sukumar Mondal, an inhabitant of Tugapur No. 6 under Police Station Mayabunder on 11/09/2024 for committing aggravated penetrative sexual assault upon a minor girl of 10 years age and sent him to the judicial custody for reflection of mind for hearing of quantum of punishment on 12/09/2024.
In a nut-shell is that on 03/05/2023 when the victim girl was returning back to her home after purchasing fish from shop at Tugapur No.6, when she reached near the Govt School, Tugapur No.6, the accused person met the victim girl and took her to the jungle behind the Govt School and opening her lower under garments put his finger into the private part of victim girl and said the accused to the victim girl not to disclose the fact to anybody else and tempted to give money to victim and the victim girl went to her house.
Thereafter, on 09/05/2023 when the parents and brother of victim girl went to the forest situated behind the house of victim girl to tie leaf and the victim girl was alone at home, she was watching television and was eating meals, at the same time the accused person came the house of victim girl and inquired to the victim girl about the parents and the other family members of the victim girl and she replied to the accused that no body was at home.
Thereafter, the accused person took the victim girl to beside the iron trunk and opened the pant of accused half and opened the lower garments of victim and covered the mouse of the victim girl by the hand of accused and laid on the floor and touched the private part of accused person with the private part of the victim. At the meantime, the sister-in-law (Bhabi) of victim girl reached at the place of occurrence, seeing of sister in -law of victim girl, accused person left the place of occurrence.
On the basis of fardbayan of victim girl, one FIR was lodged at PS Mayabunder bearing FIR No. 25 of 2023 dated 09/05/2023 under section 5 (1) (m) (n)/6 of POCSO Act, 2012.
The convict namely Sukumar Mondal has been produced before the Court on 12/09/2024 from judicial custody and after hearing the submission of both convict and prosecution side, the Hon’ble Special Judge has pronounced the judgment in open court and sentenced to undergo rigorous imprisonment for twenty years with fine of Rs. 20,000/- (rupees twenty thousand), and in default of payment of fine to suffer further rigorous imprisonment for five months for the offence punishable u/s 6 of POCSO Act, 2012 and also sentenced to suffer rigorous imprisonment for four years with a fine of Rs.4,000/- (rupees four thousand), and in default of payment of fine to suffer further rigorous imprisonment for four months for the offence punishable u/s 8 of POCSO Act, 2012.
The punishment for above noted offence shall run concurrently. The Hon’ble Court has also awarded compensation to the mother of the victim for rehabilitation of her victim girl through District Legal Services Authority, Andaman & Nicobar Islands. The investigation of the instant case is done by Sub- Inspector Silpa Dutta and Inspector Gracefield of Police Station Mayabunder under the supervision of Inspector P.K Abdul Arif, former SHO, PS Mayabunder with close monitoring of Smti. Geetanjali Khandelwal, IPS, Superintendent of Police (D), Mayabunder . The State Prosecution was conducted by Shri Keshab Chandra Mondal, Ld. Special Public Prosecutor (POCSO Act).
