Port Blair, Aug 30: Mr. JimutBahan Biswas, Hon’ble Additional Sessions Judge, North & Middle Andaman District, Mayabunder has convicted one person namely Gobinda Chakraborty, R/o Pitcher Nallah, Swadesh Nagar, Billiground on 26th August 2022 for committing rape upon 39 years old aged mentally and physically disabled woman.
The crime was committed during Jan-Feb 2021, when the victim woman was forcefully confined, assaulted, and threatened and consequently, the woman became pregnant.
DNA profile report revealed that the convicted is the biological father of the fetus. Accordingly, a case was registered in PS Billiground vide FIR No. 24 of 2021, dated 30/07/2021 based on the statement of the victim. The Hon’ble Judge has sent the convict to the judicial custody for reflection of mind to hear the quantum of punishment and on 29th August 2022, the convict was produced from judicial custody and after hearing the convict as well as prosecution and defence side by the Hon’ble Judge, the convict was sentenced to undergo rigorous imprisonment for ten years for the offense punishable under section 376 (2) (1) of Indian Penal Code and also to pay fine of Rs. 1,00,000/- (one lakh), out of which 90% amount is to be paid to the victim as Compensation U/s 357 of CrPC, in default of payment which he will have to undergo rigorous imprisonment for one more year.
The Hon’ble Judge has also awarded a compensation amount of Rs.3,00,000/- (three lakhs) U/S 357(A) of CrPC which will be paid by the State Government from the Victim Compensation Fund.
The entire case was investigated by SI Agnes Bartholoma under the direct supervision of SI Madhab Halder, SHO, PS Billiground. The prosecution case was conducted by Mr. UttamKirtonia, learned Additional Public Prosecutor, North & Middle Andaman District, Mayabunder.
