Port Blair, Jun 13: Mr. Jimut Bahan Biswas, Special Judge under the POCSO Act, North & Middle Andaman District, Mayabunder has convicted one accused person namely Mr. Vishal, an inhabitant of Car Nicobar on 10th June 2022 for committing an aggravated penetrative sexual assault upon a minor girl of 17 years age and sent him to the judicial custody for reflection of mind for hearing of quantum of punishment.
In a nutshell, the accused and victim were in a love affair and due to this they had performed physical relationship multiple times at the house of the accused person’s uncle situated at Navin Nagar, Diglipur and on medical test at Dr. BJR Hospital, Car Nicobar, it was detected that the victim became pregnant.
On the basis of a written statement of the victim girl, one zero FIR was lodged at PS Car Nicobar and thereafter, a formal FIR was registered in PS Diglipur vide FIR No. 73 of 2019 dated 21/07/2019 under section 5/6 of the POCSO Act, 2012
The convict namely Mr. Vishal was produced before the Court on 13th June 2022 from judicial custody and after hearing the submission of both convict and prosecution side, the Special Judge has pronounced the judgment in open court and sentenced him to undergo rigorous imprisonment for life and also imposed a fine of Rs. 2,00,000/- upon him, out of which 90% of the fine amount is to be paid to the victim girl as compensation.
The Hon’ble Court further awarded a compensation of Rs. 5,00,000/- to the victim girl from Victim Compensation Fund. The Hon’ble Special Judge had also appreciated the industrious investigation done by the ASI Abdul Salam and SI Adi Moorthy of the case under the supervision of Inspector Pritam Bchari, former SHO, PS Diglipur. The State Prosecution was conducted by Shri Keshab Chandra Mondal, Ld. Special Public Prosecutor (POCSO Act).
