Port Blair, Dec 16: The Labour department has been entrusted with enforcement of 18 Central Labour Acts and 01 Regulation in these Islands. It is mentioned that all the establishments operating in these islands are to comply with various provisions of these Acts. It is the statutory duty that:
• All contract establishments obtain License under Contract Labour Act (R&A) 1970 when engaging 20 or more workers.
• All contract establishments obtain Registration/License under Building & Other Construction Workers Act (RE&CS) 1996 when engaging 10 or more workers.
• All Shops & Commercial Establishment need to obtain Registration under A&N Islands Shop & Commercial Establishment Regulation 2005 whether employing any workers or not.
• The Contract Establishments bringing workers from mainland need to register with the Department under Inter-State Migrant Workers Act.
It is also informed that all employers have to pay Minimum wages as notified by A&N Administration from time to time and also maintain registers of wages/Leave with wages/Over time/Attendance and issue Wages slip to the workers.
Recently the Assistant Labour Commissioner (N&M) filed 08 cases before the Hon’ble Chief Judicial Magistrate, Mayabunder while 06 cases were disposed off and the erring contractors/employers were imposed penalty/fine to the tune of Rs 9900/-.
The Employer of different shops & Establishments and Govt. Contractors working in A&N Islands may get their list of their obligation under various Labour Laws from Assistant Labour Commissioners of concerned areas of strict Compliance thereby to avoid penalty.
