Rigorous Imprisonment for Sexual Offence upon Six Years Minor Girl

Mayabunder, April 29: Shri. Jimut Bahan Biswas Hon’ble Special Judge Under POCSO Act North and Middle Andaman, Mayabunder has convicted one accused person namely Amir Hussain, aged about 56 years, R/o Rangat Sitapur Under PS Rangat’ and sentenced to undergo rigorous imprisonment for five years for the offence punishable under section 10 of POCSO Act 2012 and also to pay a fine of Rs 50,0000 (Rupees Fifty Thousand), out of which 90 percent amount is to be paid to the victim girl as compensation U/s 357 of Cr. P.C, in default of payment which convict will have to undergo rigorous imprisonment for six months more.
A case under POCSO Act, 2012 was registered in the Police Station Rangat Vide FIR No. 16/22 dtd.04/04/2022 on the basis of fardbayan by the mother of victim girl. The fact of the case is that on 04/04/2022 during the evening time at about 0500-0600 pm in the absence of the parents of the six years victim child, the adjacent neighbour Accused Amir Hussain aged about 56 years came to the house of the victim child and removed her wearing apparels and sucked her private part. The child victim screamed and cried then the accused left her. The mother of the victim child knowing the fact from the victim child made a complain to the Police Station Rangat and by the SHO PS Rangat initiated the case.
For the rehabilitation of the victim girl, an amount of Rs 50,000/ (rupees fifty thousand) has been awarded as compensation as per provision of 357 A of Cr. P.C from the victim compensation fund. The case was investigated by SI Mariam of PS Rangat under the guidance of Insp. Shri Barun Adhikari (SHO PS Rangat) under the supervision of Shri. Hukma Ram, Dy.S.P Rangat under the overall supervision of Shri. Vichitra Veer, IPS, Superintendant of Police North and Middle Andaman. The entire prosecution case was conducted by Shri. Keshab Chandra Mondal learned Special Public Prosecutor (POCSO Act) Maybunder.
