Sri Vijaya Puram, Feb 28: Mr. Subhajit Basu, Special Judge under POCSO Act 2012, North & Middle Andaman District, Mayabunder has convicted one accused person resident of Oral Katcha, Under Baratang Police Station on 27/02/2025 for committing rape on a minor girl of 17 years old and sent him to judicial reflection of mind for hearing of quantum of punishment on 28/02/2025.
In a nut-shell is that the victim girl is the full blooded sister of the accused person and she used to reside in the same parental home. The victim girl became victim of multiple aggravated penetrative sexual assaults by her own elder brother.
Later on victim’s complain and on the basis of her statement of the victim girl an FIR No. 41/2023 registered on 13/12/2023, U/S 5(1)(n)/6/9(1)(n)/10 of POCSO ACT 2012 at Baratang PS against the accused person.
The convict has been produced before the Court on 28/02/2025 from Judicial Custody and after hearing the submission of both Prosecution as well as convict side, the Special Judge has pronounced the Judgment in open Court and sentenced under section 235(2) of Cr.P.C. to suffer rigorous imprisonment for 20 years with the fine of Rs. 20,000/- (Rupees Twenty thousand only), and in default of payment of fine to undergo rigorous imprisonment for term of 05 months for the offence punishable under section 6 of POCSO Act and is sentenced to suffer rigorous imprisonment for term of 05 years with a fine of Rs. 4,000/- and in default of payment of fine to undergo rigorous imprisonment for 04 months for the offence punishable under section 10 of POCSO Act. The punishment prescribed for the above noted offences shall run concurrently. In view of the Special Judge that it would be fit and proper to award payment of compensation to be awarded to the victim for her rehabilitation. under the victim’s compensation scheme.
As per a press release, the investigation of the instant case done by Sub-Inspector Silpa Dutta under the supervision of Sub-Inspector Surjit Bhattacharjee, SHO PS Baratang with close monitoring of SDPO, Rangat and Superintendent of Police (D) N & M Andaman District, Mayabunder the State Prosecution was conducted by Mr. Keshab Chandra Mondal, Ld. Special Public Prosecutor (POCSO Act).
