Port Blair, Oct 05: The Hon’ble Special Court under the POCSO Act, North & Middle Andaman, Mayabunder presided by Shri Jimut Bahan Biswas on 05.10.2021 convicted one Saranga Mondal, a resident of Billiground under section 6 of the POCSO Act, 2012. The convict was accused of committing aggravated penetrative sexual assault upon a minor girl of 15 years age.
It is learnt that the convict was engaged by the father of the victim to perform some kind of puja to bring back his wife who had eloped with another person. The convict had convinced the father of the victim to conduct the puja beside a nallah.
The prosecution version is that the convict under the pretext of organizing the puja, took the victim girl along with him in his bicycle near the nallah where the puja was to be conducted and committed rape upon her.
The Hon’ble Court of Learned Additional District & Sessions Judge, Mayabunder being the designated Special Court under the POCSO Act, 2012 tried the case which was registered as Billiground PS FIR No. 30/18 dated 03.04.2018 under section 6 of the POCSO Act, 2012 and under section 506 of the IPC.
The Hon’ble Special Court while sentencing the convict, Saranga Mondal to undergo rigorous imprisonment for life and also imposed a fine of Rs. 2,00,000/- upon him out of which 90% of the amount is to be paid to the victim as compensation.
The Hon’ble Court further awarded a compensation of Rs. 5,00,000/- to the victim and entrusted upon the Administration the responsibility of disbursing the compensation amount within 30 days through the office of District Legal Services Authority, A & N Islands and District Magistrate, North & Middle Andaman District, Mayabunder.
The Hon’ble Special Court had also in its judgment appreciated the investigation done by the 10/ SI Ranga Raj of the case. The State Prosecution was conducted by the learned Special PP, Shri Keshab Chandra Mondal.
Bambooflat Resident convicted in POSCO Case; Court of Special Judge POCSO awards punishment for twenty years
Port Blair, Oct 01: The Court of Special Judge POCSO at Port Blair, Shri Raja Chatterjee on 29/09/2021 convicted one person namely Mohd. Javed resident of Bambooflat village who has been sentenced to suffer rigorous imprisonment for 20 years and to pay fine of Rs. 5000/- in default to suffer rigorous imprisonment for 05 months for the offence punishable u/s 6 of the POCSO Act, and also to suffer rigorous imprisonment for 01 year and to pay Rs. 1000/- only in default to suffer rigorous imprisonment for 01 month for the offence punishable u/s 323 of the IPC and to suffer rigorous imprisonment for 07 years and to pay fine of Rs. 2,000/- only in default , to suffer rigorous imprisonment of 03 months for the offence punishable u/s 506 of the IPC. If the fine is paid by the convict the fine amount shall be paid to the victim girl/survivor to meet her medical expenses and rehabilitation of such victim as per provision of section 6(2) of the POCSO Act.
The case originated on the basis of statement dated 08/02/2021 by the aunt of victim (Maasi) who lodged a complaint against the accused Mohd. Javed who caused aggravated penetrative sexual assault upon a minor girl who was aged about 09 years repeatedly in his house. The victim used to address her aunt and the accused namely Mohd. Javed as Mummy and Papa. The victim stated that she used to reside at Child Care Institution and during lockdown her aunt brought the victim girl to reside with her in her house. On one fine day when her aunt (Maasi) returned from work she noticed that the victim girl was traumatized and her son (Maasi son) informed that accused Mohd. Javed committed some mischief and assaulted the victim girl. On being asked the victim girl disclosed her aunt that since past few months accused was repeatedly committed mischief, as a result she sustained bleeding injury and severe swelling on her private parts. The accused threatened the victim girl not to disclose the incident to anyone. He had also caused physical assault upon her person as there was injuries present in her various parts of body which was duly proved by the Doctor who examined her. The investigation took up by the Investigating Officer namely Smti. Shilpa Dutta. The Prosecution examined all witnesses and was able to successfully proved the case beyond reasonable doubt. It is pertinent to mention that the case was registered on 08/02/2021 and the judgement was delivered within a span of 07 months.
The Hon’ble Special Court observed in the order that since the victim girl resides in child care institution as her biological mother is no more in the world and her biological father is in judicial custody in connection with some other criminal proceedings, the series of incidents involved in the case has caused physical trauma and thus her rehabilitation is of prime importance, so taking into account all these factors the victim girl has been awarded compensation amounting to Rs. 4,00,000/-(Rupees Four Lakhs only) which is to be paid by A&N Administration within a period of 30 days. The case was contested by Special Public Prosecutor, Miss. A. S. Zinu.
Life Imprisonment by Hon’ble POCSO Court, Mayabunder
Mayabunder, September 27: The Hon’ble Special Court under POCSO Act, Mayabunder has convicted one accused person namely Basudev Ram R/O Radhanagar PS Diglipur and sentenced to undergo rigorous imprisonment for life for the offence punishable under section 6 of POCSO Act, 2012 and also to pay fine of Rs.2,00,000/- (rupees two lakhs), out of which 90 percent amount is to be paid to the victim girl as compensation u/s. 357 of Cr.P.C, in default of payment which convict will have to undergo rigorous imprisonment for one year more. The judgment was passed by Shri. Jimut Bahan Biswas, Hon’ble Additional Sessions Judge -cum- Special Judge under POCSO Act, North & Middle Andaman District, Mayabunder.
A case under POCSO Act was registered in the Police Station, Diglipur vide FIR No. 39 of 2020 on the basis of written complaint lodged by the victim girl, This is a custodial trial case wherein the prosecution has sufficiently proved that the accused person who was already married with four children has committed the offence under section 6 of POCSO Act, 2012 for committing aggravated penetrative sexual assault upon a innocent unfortunate minor girl aged about sixteen years.
For the rehabilitation of victim girl, an amount of Rs.5,00,000/- (rupees five lakhs) has been awarded as compensation as per provision of 357A of Cr.P.C from Victim Compensation Fund. The entire case was investigated by Si Tamil Arasan under the guidance of Inspector Pritam Behari, former SHO, PS Diglipur for which the Hon’ble Court has appreciated for energetic investigation. The prosecution case was conducted by Shri. Keshab Chandra Mondal, learned Special Public Prosecutor (POCSO Act), Mayabunder.
POCSO Court Mayabunder Convicted one accused for Life Imprisonment
Mayabunder, Sept 24: The Hon’ble Special Court under POCSO Act, Mayabander has been functioning in the adverse atmosphere in this prevailing situation of COVID-19 pandemic but speedy disposal of the cases are continuing and remarkable.
One case under POCSO Act was registered in the Diglipur Police Station on the basis of fardbayan of victim girl in the year 2020. The prosecution has sufficiently proved that the accused person has committed the offence under sections of POCSO Act, 2012 for committing aggravated sexual assault upon a minor girl aged about 15 years
Accordingly, Shri. Jimut Bahan Biswas Hon’ble Additional Sessions Judge-cum-Special Judge under POCSO Act, North & Middle Andaman District, Mayabunder has found the accused person namely Subrato Mondal, R/o Jagannath Dera, PS Kalighat guilty and sentenced him to undergo rigorous imprisonment for life for the offence under sections of the POCSO Act, 2012 under the provision of 235(2) of CPC and also to pay fine of Rs 2,00,000 out of which 90% amount is to be paid to victim girl as compensation under section 357 CPC, in default of payment which he will have to undergo rigorous imprisonment for one year more.
For the rehabilitation of victim girl, an amount of Rs 5,00,000 – has been awarded as compensation as per provision of 357A of Cr.Pc. rws 33(8) of POCSO Act and rule 7 of POCSO Act from Victim Compensation Fund. The entire case was investigated by SI Jishi George for which the Hon’ble Court has appreciated for her good performance. The prosecution case was conducted by Shri Keshab Chandra Mondal, Learned Special Public Prosecutor (POCSO Act), Mayabunder.

Jimut Bahan Biswas, Hon’ble Additional Sessions Judge -cum- Special Judge under POCSO Act, North & Middle Andaman District Mayabunder has found the accused person namely Sourav Mondal R/o Curtbert Bay, Billiground guilty and sentenced him to undergo rigorous imprisonment for three years for the offence under section 8 of the POCSO Act, 2012 under the provision of 235(2) of Cr.PC and also to pay fine of Rs.50,000/, out of which 90% amount is to be paid to victim girl as compensation under section 357 Cr.PC, in default of payment which he will have to undergo rigorous imprisonment for six months more.
For the rehabilitation of victim girl, an amount of Rs 50,000/- has been awarded as compensation as per provision of 357A of Cr.P.C from Victim Compensation Fund. The entire case was investigated by SI Arthi Roy under the guidance of SI Deben Kumar Roy, former SHO, PS Billiground for which the Hon’ble Court has appreciated for her good performance. The prosecution case was conducted by Shri. Keshab Chandra Mondal learned Special Public Prosecutor (POCSO Act), Mayabunder.
One Arrested for Impregnating Minor

Port Blair, Sept 22: The Andaman and Nicobar Police yesterday arrested a resident of Tugapur area for impregnating a minor girl.
As per information received from reliable sources a minor girl yesterday went to Dr. R P Hospital, Mayabunder for treatment. During the medical checkup, Doctor found her pregnant for more than two months and consequently the matter was informed to nearby police station.
On receipt of the complaint from Hospital, Police team under the direction of SHO, swung into action and within hours the accused was arrested. He was later produced in court from where he was sent to Judicial Custody.
One Arrested for stealing Gold Ornaments

Port Blair, Sept 20: On 17 September a theft case was reported in Chatham Police Station from a house near Sunder Colony, Agriculture Office, Haddo.
Investigating in this case Andaman and Nicobar Police arrested a 29 year old youth from Haddo area.
As per information on 17 September 2021 a house owner left his house for personal works and when he returned home in the evening, he saw the doors of his house are open and all gold ornaments, nearly 40 grams, are stolen.
The Chatham Police team worked very hard in this case and cracked the case in no time. All Gold Ornaments were reportedly recovered. Further details are awaited.
Bollywood Style Kidnapping, reported from Port Blair; Police registers FIR

Port Blair, Sept 09: A Bollywood style kidnapping case has been reported from Port Blair in which a resident of Stewart Gunj was reportedly kidnapped by unknown people from Phoenix Bay area on 07 September and was dropped out of an Omni, near Hornbill Nest on 08 September evening.
As per details, since 07 September 2021, a resident of Stewart Gunj, Mr. P P Ibrahim was missing and his family members have lodged a missing complaint at PS Bambooflat. Mr. Ibrahim is working in a private ship repairing company.
Yesterday evening some people saw a man struggling near the drain of Hornbill Resort, whose hands and legs were tied. Soon the information was passed to Police Department. Later police team shifted him to G B Pant Hospital and identified him as Mr. PP Ibrahim, who was missing since yesterday.
According to sources Mr. Ibrahim reportedly gave statement that he was kidnapped by some unknown people in an Omni, who took him some unknown place and left him road side, after one day. He was reportedly beaten also.
However, reason behind the kidnapping is still not known. The Andaman and Nicobar Police has reportedly lodged a kidnapping case in this regard and further details are awaited.
Three Persons Booked For Gambling By Mayabunder Police Station
Port Blair, Sept 05: On 03/09/2021 late evening, when SHO/Mayabunder was on patrolling, he received an information that a car is parked in an isolated area and some persons are sitting in that. That sounded suspicious as to what those persons might be doing in the car by parking in an isolated area, he decided to send a police team and get the information checked. When the police team reached there, they found that three persons namely Proshanta Biswas R/o Swadeshnagar, Billiground, Gokul Baroi R/o Pinaki Nagar, Billiground and P. Sakthivel R/o Mayabunder were gambling in the car, putting bet money on the game of cards. The police team carried out the proceedings of seizures etc. as per the legal procedure. The persons were booked for the violation of Gambling Regulation with the seizure of bet money amount to Rs. 1.07 Lakhs. The raid and legal proceedings were done by SHO/Mayabunder Insp. Usman Ali under the supervision SDPO/Diglipur Shri. R.K.Sharma.
Strict action by the district police on any information given by the public is winning the trust of the people and they are coming forward to share the information with police, though most of them prefer that their names be kept secret.
One arrested for impregnating Minor Girl

Port Blair, Sept 02: Yesterday morning, a POCSO case was reported in Police Station Bambooflat .
As per source yesterday a 16 year old girl parent was brought to a Hospital for medical checkup. During checkup doctors found that the girl is pregnant.
Immediately the information was given to Bambooflat Police station.
Later, Police Team investigated the matter and arrested a 41 Year old man in this matter, further details are awaited.
