Hut Bay, Aug 09: The police department today arrested a private school teacher from Hut Bay on Murder charges. According to reports the teacher, Mr. Pankaj Rai, who commands a good reputation in Little Andaman area had a verbal spat with Mr. Joshorath Dhali, a resident of R K Pur, Village.
As per villagers Mr. Joshorath Dhali was under heavy influence of liquor when this incident took place and during the verbal spat, Mr. Pankaj Rai, pushed Joshorath Dhali, away but as per details Joshorath Dhali lost balance and suffered serious injuries, which resulted in his death, after he was shifted to Hut Bay Hospital.
On information police arrested Mr. Pankaj Rai, who will be sent to Port Blair tomorrow. It is learnt that a case under section 302 has been registered against Mr Pankaj Rai but it is said that police might change the section into unintentional murder, considering the situation.
Yes, It is clearly an accident . It should not be seen /Lodged under section 302 as it was unintentional
Moreover, the Convict Pankaj Rai didnt have any destructive weapons or tools to harm the person intentionally neither he used one from the Vicinity
A person who was already drunk and was actually unstable , would definitely loose his balance and would fall down.
Also, The well reputed Teacher Pankaj Rai , who was successful to get Fame within short period of time, carried the Drunkard to the Hospital in an auto as per the Sources.
This case should not be filed under the section 302 .
Had there been any girl , who was teased by the same Drunkard and what if the Girl had pushed the person and he dies after few hours from then.. Would the gurl still be charged under the IPC section 302 ?
So, this case should be seen as an accident or a Mishap under self -defiance and absolutely nothing else.
