Life Imprisonment for Committing Rape on Minor Girl

Mayabunder, 23 April: Mr. Jimut Bahan Biswas, Hon’ble Additional Sessions Judge -cumSpecial Judge under POCSO Act, North & Middle Andaman, Mayabunder has found guilty the accused namely Subham Mazumder Slo Mr. Subhash Chandra Mazumder (24 years) R/o Subhash Gram, Ward No.1, Diglipur and sentenced him to undergo imprisonment for life for the offence under section 6 of POCSO Act, 2012 under the provision of 235 (2) of Cr.P.C and also to pay fine of Rs.2,00,000/- (rupees two lakhs only), out of which 90 percent amount is to be paid to the victim as compensation under section 357 Cr.P.C, in default of payment which he will have to undergo rigorous imprisonment for one year more. This is the story of minor girl of seventeen years at the time of incident and who has been raped, ravished and sexually exploited by wrongdoer. Consequence of such incident, the victim became pregnant. The factual matrix as reflected in a nut-shell is that the victim and accused both have consented physical relationship and on medical check-up it was detected and confirmed that minor girl was pregnant. For that reason, FIR No.32 of 2020, dated 12/03/2020 under section 5/6 of POCSO Act, 2012 read with section 376 of IPC has been lodged at Police Station Diglipur.
It was learnt that accused tried to flee away from this islands to mainland before pronouncement of judgment but the quick alertness of Investigating Officer and Inspector N. Stalin, SHO, PS Diglipur under the close supervision of Superintendent of Police, Mayabunder, the effort of accused has gone in vain.
For the rehabilitation of victim girl, an amount of Rs.5,00,000/- (rupees five lakhs only) has been awarded as compensation as per provision u/sec. 357A Cr.P.C read with section 33 (8) of POCSO Act and rule 7 of POCSO rule, which will be paid by the Government from Government Fund through NEFT. The entire case was investigated by SI Shiju Kumar which was appreciated for good performance and the Charge-sheeting Officer was Inspector Pritam Behari, former SHO, Police Station Diglipur. The prosecution case was jointly conducted by Mr. Keshab Chandra Mondal and Mr. Uttam Kirtania, Learned Special Public Prosecutors under POCSO Act, Mayabunder.
